“The Ins and Outs of the Consent and Capacity Board”

Presenter:  Dr. Dave Langlois, PhD, Clinical Ethicist, Centre for Clinical Ethics

Overview:  The Consent and Capacity Board is an independent tribunal, established by the Health Care Consent Act (1996), to conduct hearings regarding substitute decision-making, findings of incapacity, and involuntary psychiatric admission.  Although the Board is sometimes viewed with trepidation, it is an invaluable resource for clinicians, patients, and family members.  In this month’s Ethics Grand Rounds, we’ll explore how the Board works, highlight the Board’s many uses, and examine some recent cases and decisions.

Learning Objectives

  • To provide an overview of how the Board works and the range of applications that can be made to the Board.
  • To explore how the Board can be used by clinicians, patients, and families when navigating ethically challenging cases.
  • To review and derive lessons from a number of complex cases recently reviewed by the Board.
